No HIPAA/GLBA assumption. Unless we expressly state otherwise, the Services are not intended to collect information regulated by HIPAA (health information) or GLBA (certain financial information).

We use cookies and similar technologies to:
keep you signed in (where applicable);

support advertising and measurement (where applicable).

You can control cookies through your browser settings and, where available, our cookie banner or preference center. Blocking certain cookies may impact Service functionality.

4.3 Targeted Advertising / “Sharing” (Certain States)

We may permit third parties to use cookies, pixels, SDKs, or similar technologies to collect information over time and across different websites, apps, and services to display ads that may be more relevant to you and to measure ad performance. Under some state laws, this may be considered “targeted advertising” and/or “sharing” for cross-context behavioral advertising.

You may have the right to opt out of these activities as described in Section 9.

4.4 Do Not Track Signals

Some browsers transmit “Do Not Track” (DNT) signals. There is no uniform industry standard for DNT; therefore, we do not respond to DNT signals unless required by law.

5. How We Disclose Information

We may disclose information in the following circumstances:

Service providers: to vendors who provide services on our behalf (e.g., hosting, analytics, customer support, payment processing, security). Service providers are authorized to use information only as necessary to provide services to us.
Business transfers: in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, where information may be transferred as part of the transaction.
Legal and safety: to comply with law, regulation, legal process, or governmental request; to enforce our terms; to protect rights, property, and safety of the Company, users, or others.
With your direction or consent: when you ask us to share or you consent to disclosure.
Aggregated/de-identified information: we may disclose information that has been aggregated or de-identified in a manner that cannot reasonably be used to identify you.

6. Data Retention

We retain information for as long as reasonably necessary to:
provide the Services;
maintain business records;
comply with legal obligations;
resolve disputes; and
enforce agreements.

Retention periods vary based on the type of information and the purposes for which it is collected and used. We may de-identify information and retain it in that form where permitted by law.

7. Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect information. However, no security measure is perfect, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of any account credentials and for any activity under your account.

8. Children’s Privacy (COPPA)

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn we have collected personal information from a child under 13, we will take steps to delete it. Parents/guardians who believe their child provided information may contact us using the details in Section 13.

If you are between 13 and 18 (or the age of majority where you live), you may use the Services only with the involvement of a parent or guardian where required by law.

9. U.S. State Privacy Rights (CCPA/CPRA and Other State Laws)

Depending on your state of residence (including California, Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah, Virginia, and others), you may have certain rights regarding your personal information.

Sensitive personal information: We do not intentionally collect “sensitive personal information” as defined by some laws (e.g., government IDs, precise geolocation, health data) except where you provide it and it is necessary for a requested service, or as otherwise permitted by law. Where required, we provide additional rights and disclosures.

We also do not engage in targeted advertising based on Personal Information, although our vendors may engage in this practice.

Because the Company does not engage in these activities, we do not provide a “Do Not Sell or Share My Personal Information” mechanism.

9.8 How to Submit a Privacy Request

You may submit a request by emailing privacy@marathongroup.com

We will verify your request by using information associated with your account or other reasonable methods. You may also appeal certain decisions if required by applicable law; appeal instructions will be provided in our response where applicable.

10. Email, SMS, and Marketing Choices

Even if you opt out of marketing, we may still send non-promotional communications (e.g., account notices, security alerts, transaction confirmations).

11. Third-Party Links and Services

The Services may include links to third-party websites or services. We are not responsible for the privacy practices of those third parties. Your interactions with third parties are governed by their privacy policies.

12. International Users

We are based in the United States, and we may process and store information in the United States and other locations where our service providers operate. If you access the Services from outside the United States, you understand that your information may be transferred to and processed in the United States and other jurisdictions that may have different data protection laws.
